Civil and Commercial Contracts

Civil and Commercial Contracts

This book addresses the three most important named contracts: sale, lease, and construction, due to their practical significance. These contracts are among the most frequently used in daily life, and they contain fundamental legal principles that are essential for the legal education of law students. The application of these rules extends to other contracts as well. Named contracts are those widely recognized among individuals, prompting lawmakers to define them and allocate an independent framework for them, whether in civil law, commercial law, or specific laws like real estate leasing.
The book is divided into three sections, dedicating one section to each contract. Each section includes a description of the nature of the contract, how it is concluded, the legal effects that arise from it, and its termination. The Qatari legal texts are explained in detail, compared to several other legislations, and the rulings of Qatari courts that have practically applied those texts are presented.
The sales contract is one of the most important contracts concerning property rights. It is regulated by Qatari legislation in Articles (419) to (487) of the Civil Code, and in Articles (88) to (164) of the Commercial Law. The lease contract is regulated by Qatari legislation in two places: first, in the Civil Code from Articles (582) to (637), and second, in the Qatari Lease Law No. (4) of 2008 and its amendments. The construction contract is regulated by Qatari legislation in Articles (682) to (715) of the Civil Code.
